Tento z\u00e1kon upravil uplat\u0148ovanie z\u00e1sady rovnak\u00e9ho zaobch\u00e1dzania a ustanovil prostriedky pr\u00e1vnej ochrany, ak d\u00f4jde k poru\u0161eniu tejto z\u00e1sady. Rovnak\u00e9 zaobch\u00e1dzanie spo\u010d\u00edva v z\u00e1kaze diskrimin\u00e1cie z ak\u00e9hoko\u013evek d\u00f4vodu vo v\u00fdkone pr\u00e1v a povinnost\u00ed v s\u00falade s dobr\u00fdmi mravmi, ako aj v prij\u00edman\u00ed opatren\u00ed na ochranu pred diskrimin\u00e1ciou.<\/p>\n<p>Pod\u013ea tohto z\u00e1kona je priamou diskrimin\u00e1ciou konanie alebo opomenutie, pri ktorom sa s osobou zaobch\u00e1dza menej priaznivo ako sa zaobch\u00e1dzalo alebo by sa mohlo zaobch\u00e1dza\u0165 s inou osobou v porovnate\u013enej situ\u00e1cii.<\/p>\n<p>Nepriama diskrimin\u00e1cia je pod\u013ea tohto z\u00e1kona navonok neutr\u00e1lny predpis, rozhodnutie, pokyn alebo prax, ktor\u00e9 znev\u00fdhod\u0148uj\u00fa osobu porovnan\u00edm s inou osobou, pri\u010dom nepriamou diskrimin\u00e1ciou nie je tak\u00fdto postup, ak s\u00fa objekt\u00edvne od\u00f4vodnen\u00e9 sledovan\u00edm opr\u00e1vnen\u00e9ho z\u00e1ujmu a s\u00fa nevyhnutn\u00e9 na dosiahnutie tak\u00e9ho z\u00e1ujmu.<\/p>\n<p>Tento z\u00e1kon definuje aj ob\u0165a\u017eovanie, ktor\u00fdm je tak\u00e9 zaobch\u00e1dzanie s osobou, ktor\u00e9 t\u00e1to osoba m\u00f4\u017ee od\u00f4vodnene pova\u017eova\u0165 za nepr\u00edjemn\u00e9, nevhodn\u00e9 alebo ur\u00e1\u017eliv\u00e9 a ktor\u00e9ho \u00famyslom alebo n\u00e1sledkom je alebo m\u00f4\u017ee by\u0165 zn\u00ed\u017eenie d\u00f4stojnosti tejto osoby alebo vytvorenie nepriate\u013esk\u00e9ho, poni\u017euj\u00faceho alebo zastra\u0161uj\u00faceho prostredia, alebo ktor\u00e9ho strpenie m\u00f4\u017ee poklada\u0165 za podmienku na rozhodnutie alebo v\u00fdkon pr\u00e1v a povinnost\u00ed vypl\u00fdvaj\u00facich z pr\u00e1vnych predpisov. Z\u00e1kon definuje, \u010do je pokynom na diskrimin\u00e1ciu, nab\u00e1danie na diskrimin\u00e1ciu, aj neopr\u00e1vnen\u00fdm postihom. Stanovuje povinnos\u0165 dodr\u017eiava\u0165 z\u00e1sadu rovnak\u00e9ho zaobch\u00e1dzania v n\u00edm definovan\u00fdch oblastiach spolo\u010densk\u00e9ho \u017eivota a ustanovuje aj mechanizmus na dosiahnutie rovnak\u00e9ho zaobch\u00e1dzania a na ochranu pred diskrimin\u00e1ciou.<\/p>\n<p>Pr\u00e1va na rovnak\u00e9 zaobch\u00e1dzanie a na ochranu pred diskrimin\u00e1ciou sa mo\u017eno dom\u00e1ha\u0165 na s\u00fade a ako n\u00e1hradu za poru\u0161enie pr\u00e1va na rovnak\u00e9 zaobch\u00e1dzanie alebo diskrimin\u00e1ciu je mo\u017en\u00e9 \u017eiada\u0165 aj nemajetkov\u00fa ujmu v peniazoch.
